Dhanbad news, DCA election : धनबाद क्रिकेट एसोसिएशन (DCA) के चुनाव पर बोर्ड ऑफ एडवाइजर अवधेश कुमार सिंह ने कई सवाल उठाए हैं। उन्होंने इस बाबत झारखंड स्टेट क्रिकेट एसोसिएशन (JSCA), डीसीए के अध्यक्ष और रिटर्निंग ऑफिसर को एक पत्र लिखा है। उन्होंने अपने पत्र में बताया है कि इस चुनाव में लोधा कमेटी की सिफारिशों, जेएससीए के संविधान का खुल्लम खुल्ला उल्लंघन हो रहा है। इसलिए डीसीए के चुनाव को अविलंब रोका जाए।

डीसीए द्वारा जारी किए गए पत्र को ही मुद्दा बनाया

धनबाद क्रिकेट एसोसिएशन के बोर्ड ऑफ एडवाइजर अवधेश कुमार सिंह ने डीसीए के पत्रांक संख्या Ref: DCA/Election/RO/01-(2024) का उल्लेख करते हुए लिखा है कि पत्र में JSCA के संविधान को ही ताख पर रख दिया गया है। पत्र के मुताबिक डीसीए के चुनाव में सिर्फ वही व्यक्ति खड़ा हो सकता है, जो मैनेजिंग कमेटी में लगातार 5 वर्षों से हो। इसमें क्लब और स्कूल के प्रतिनिधियों को चुनाव में खड़ा होने का अधिकार नहीं है। बातचीत में उन्होंने बताया की क्लब और स्कूल ही संघ की आत्मा है। उन्हीं के कारण धनबाद क्रिकेट संघ सांस ले रहा है। ऐसे में उन्हें चुनाव लड़ने से वंचित करना कितना सही है।

पत्र में लोधा कमेटी की भी चर्चा

अवधेश कुमार सिंह ने अपने पत्र में लोढ़ा कमेटी की भी विस्तार से चर्चा की है। उन्होंने लिखा है कि खेल संघ में कोई व्यक्ति अपना एकाधिकारी व्यवस्था न जमा लें, इसके लिए इस कमेटी ने कई सुझाव दिए थे, जिसे सुप्रीम कोर्ट ने भी स्वीकार किया था। हमारा संविधान कूलिंग ऑफ की बात करता है। ऐसे में 5 साल तक मैनेजिंग कमेटी में रहने वाला व्यक्ति ही चुनाव लड़ेगा तो नये व्यक्ति को संगठन में जगह कैसे मिलेगी। उन्होंने कहा कि डीसीए के पत्र में जेएससीए के संविधान के विरुद्ध बातें हैं। ऐसे में संघ का चुनाव कितना जायज है। यह बड़ा सोचनीय प्रश्न है। उन्होंने लिखा है कि जो नियम बनाए गए हैं, वह सत्ता के विकेंद्रीकरण के लिए हैं, ताकि एक आदमी संघ पर कुंडली मारकर ना बैठ रहे। वहीं डीसीए के बनाये गए नियम एक आदमी को लंबे समय तक सत्ता पर बैठाने में सहायक प्रतीत हो रहा है।

जेएससीए के नियमों का भी हो रहा उल्लंघन

उन्होंने आगे कहा कि धनबाद क्रिकेट संघ में 20 वर्षों से कई अधिकारी पद पर कब्जा जमाए हुए हैं। यहां कूलिंग ऑफ की धज्जियां उड़ रही हैं। जेएससीए के अनुसार अधिकतम 9 साल तक कोई व्यक्ति पद पर रह सकता है। जेएससीए के इस नियम का भी धनबाद क्रिकेट संघ उल्लंघन कर रहा है। पैरंट बॉडी के नियमों को नहीं मानना घोर अनुशासनहीनता है। डीसीए को इसकी भी परवाह नहीं है।

Subject: Objection to the Arbitrary Election of Dhanbad Cricket Association in Violation of Natural Justice and JSCA Regulations.

Dear Sir,

I am writing to bring to your attention an email issued by the Secretary of the Dhanbad Cricket Association, Dhanbad, dated August 9, 2024 (Ref: DCA/Election/RO/01-2024), which is reproduced below in italics and inverted commas:

“The election for the Managing Committee 2024-2024 will be held on August 18, 2024, at the DCA office, Randhir Prasad Verma Stadium, Dhanbad, as per the schedule below:

President – 1

Sr. Vice President – 1

Vice President – 5

General Secretary – 1

Joint Secretaries – 2

Executive Members (From Life Members) – 10

Executive Member (From School) – 1

Filing of Nomination: August 11, 2024 (11:00 am. to 02:00 p.m.), Withdrawal of Nomination: August 12, 2024 (11:00 am. to 02:00 p.m.), Scrutiny: August 13, 2024 (02:00 p.m. to 04:00 p.m.), Publication of Valid Candidates: August 14, 2024 (11:00 a.m), Election Date: August 18, 2024 (10:00 am. to 01:00 p.m.).”

Further, Clause 1 of the email reads as:

“For election to the post of office bearer, a life member of the Association of at least five years standing or a person who has served any affiliated unit as an elected President or Honorary Secretary for five consecutive years, and who is a member of the current or previous Managing Committee (within five years from the date of election) and has served as a member of the Managing Committee for at least three years, shall be eligible to contest the election.”

The clause mentioned above is both unclear and confusing. To clarify, it implies that unless one has been a sitting member of the Managing Committee for the last three years and a life member for five years, or has consecutively served as President or Honorary Secretary of an affiliated unit for the last five years, they are ineligible to contest the election for office bearer. This clause unfairly discriminates between life members and committee members, which is not only unethical but also contrary to natural justice. It undermines the rights of other life members of the DCA and conflicts with the principles outlined in the Lodha Committee recommendations and the directives of the Hon’ble Supreme Court.

The requirement for a three-year sitting period for election eligibility stands in stark contrast to the “cooling-off” period mandated by the Lodha Committee and upheld by the Hon’ble Supreme Court. Rather than allowing sitting members to step down for a cooling-off period, the clause instead renders them eligible for re-election. Interestingly, I came across a list of candidates running for election, and some of them have held office bearer positions continuously for the last 20 years. This raises concerns as it seems to be a clear violation of the Lodha Commission’s directives, which were approved by the Hon’ble Supreme Court of India.

Given these issues, Clause 1 of the email infringes upon the right to equality by creating an unjust distinction between current Managing Committee members and non-members. Actions taken by the association must be grounded in reason and fairness, as these principles are central to democracy. By ensuring equal opportunities for all members of the association, we protect our institution from vested interests and the concentration of power in a few hands, fostering a “dispersal of authority” as envisioned by the Hon’ble Supreme Court of India.

I have also observed that the election for the position of “Treasurer” was not initially notified, although a corrigendum was later issued on August 9, 2024. Additionally, the original notice mentioned that the Managing Committee’s tenure would be from 2024-2024, which appears either illogical or a typographical error, as this would imply a term of only five months. This has led to confusion among members, with some believing the proposed tenure for office bearers is just five months, while others are assuming it to be from 2024 to 2027.

As a member of the Board of Advisors of the DCA, I request that the upcoming election for the office bearers of the Dhanbad Cricket Association be postponed until these anomalies are addressed and the necessary amendments are made in accordance with JSCA rules and BCCI directives. Additionally, it is important to note that the election was announced hastily, with only seven days provided from notification to the election date. This short timeframe appears to be unfair and unethical; a minimum of a fortnight notice should be given in advance to ensure a fair process.

Furthermore, please be informed that if these amendments are not addressed and the upcoming DCA election is not deferred, I will opt to abstain from the election process.
